Twosvn Limited, trading as Équisettle, also referred to in this document as "we", "us" or "our", provides these Terms & Conditions which govern your use of our website and platform (together the "Site") and our services.

Purpose of these Terms & Conditions

These Terms & Conditions set out the basis on which Twosvn Limited provides the Équisettle service to you and explains your rights and obligations when using our Site and services.

The Site is not intended for children and we do not knowingly provide services to children.

Controller

Twosvn Limited is the service provider and data controller for the purposes of providing the Équisettle platform and services.

Services We Provide

We provide an accounts receivable and collections management platform which includes:

  • Case management and workflow automation
  • Payment processing and reconciliation
  • Third-party integrations as may be configured by you
  • Communication and reporting tools

Your Use of Our Services

Account Registration

To use our services, you must register for an account and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms & Conditions. You shall not use our services in any way that:

  • Violates any applicable law or regulation
  • Infringes the rights of any third party
  • Transmits any harmful or malicious code
  • Attempts to gain unauthorised access to our systems

Your Data

You retain ownership of all data you input into our system. By using our services, you grant us a licence to process this data as necessary to provide our services to you. You warrant that you have all necessary rights and consents to process any personal data through our platform.

Third Party Services

Our platform may integrate with third-party services. Your use of such integrations is subject to the terms and conditions of those third parties. We are not responsible for the availability or accuracy of third-party services.

Fees and Payment

Our services are provided on a subscription basis. Fees are as agreed in your service agreement and are exclusive of VAT. Payment terms are as specified in your invoice.

Intellectual Property

All intellectual property rights in the Équisettle platform and our services remain our property. You are granted a limited, non-exclusive, non-transferable licence to use our services for the duration of your subscription.

Limitation of Liability

To the fullest extent permitted by law, we exclude all liability for any indirect, special, incidental or consequential damages. Our total liability to you shall not exceed the fees paid by you in the twelve months preceding the claim.

Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws. Where we process personal data on your behalf, we act as a data processor and you remain the data controller.

Term and Termination

These Terms & Conditions remain in effect for the duration of your subscription. Either party may terminate by giving notice as specified in your service agreement. Upon termination, your access to our services will cease.

Changes

We may update these Terms & Conditions from time to time to reflect changes to our services or for other operational, legal or regulatory reasons. We will take appropriate measures to inform you of material changes.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
